  • Attempt to reverse engineer, decompile, or extract the underlying AI models or algorithms
  • Use the service to spam, solicit, or conduct fraudulent activities
  • Violate any applicable laws, regulations, or third-party rights
  • Attempt to manipulate, trick, or "jailbreak" the AI chatbot to produce inappropriate responses
  • Use the chatbot for competitive intelligence gathering against Hill Country Guide AI

5. AI-Generated Content and Limitations

5.1 No Guarantee of Accuracy

Our chatbots utilize artificial intelligence and machine learning technologies. While we strive for accuracy, AI-generated responses may contain errors, inaccuracies, or outdated information. You acknowledge that:

  • Chatbot responses are generated by AI and may not always be accurate or appropriate
  • We do not guarantee the completeness, reliability, or accuracy of chatbot responses
  • You should verify important information through direct contact with the business
  • Chatbot responses do not constitute professional advice (legal, medical, financial, etc.)

5.2 Not Professional Advice

Information provided by our chatbots is for general informational purposes only and does not constitute professional advice. You should not rely solely on chatbot responses for decisions requiring professional expertise. Always consult qualified professionals for legal, medical, financial, or other specialized advice.

5.3 AI Limitations

You understand and accept that AI technology has inherent limitations, including but not limited to:

6. Intellectual Property Rights

You are granted a limited, non-exclusive, non-transferable license to use our chatbot services solely for their intended purpose. This license does not include any right to:

Hill Country Guide AI provides chatbot services to third-party businesses ("Clients"). When you interact with a chatbot on a Client's website:

  • You are communicating with the Client's business, not with Hill Country Guide AI directly
  • The Client, not Hill Country Guide AI, is responsible for fulfilling any products, services, or commitments discussed
  • Any disputes regarding products, services, or business transactions are between you and the Client
  • The Client's own terms of service and privacy policy may also apply

8.2 Third-Party Services

Our chatbots may integrate with or reference third-party services, websites, or content. We are not responsible for:

  • The availability, accuracy, or content of third-party services
  • Third-party privacy practices or terms of service
  • Any damages or losses related to third-party services

9. Disclaimers and Warranties

9.1 "As Is" Service

OUR CHATBOT SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability, fitness for a particular purpose, or non-infringement
  • Warranties that the service will be uninterrupted, error-free, or secure
  • Warranties regarding the accuracy, reliability, or completeness of AI-generated content
  • Warranties that defects will be corrected or that the service is free of viruses

9.2 No Guarantee of Results

We do not guarantee that our chatbot services will meet your specific requirements or expectations, or that use of the service will result in any particular outcome, including but not limited to business leads, sales, or customer satisfaction.

9.3 AI Technology Disclaimer

AI technology is constantly evolving and has inherent limitations. We make no warranties regarding:

  • The accuracy of AI-generated responses
  • The appropriateness of chatbot behavior in all situations
  • The prevention of all potentially offensive or biased content
  • The chatbot's ability to understand all user queries correctly

10. Limitation of Liability

10.1 Maximum Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HILL COUNTRY GUIDE AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF OUR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10.2 Cap on Liability

Our total aggregate liability for all claims arising out of or relating to these Terms or your use of our services shall not exceed $100 USD or the amount paid by the Client for the specific chatbot service in the preceding 12 months, whichever is greater.

10.3 Exclusions

We are not liable for:

  • Damages resulting from AI-generated content or responses
  • Business losses, including loss of revenue, profits, or opportunities
  • Decisions made based on chatbot interactions
  • Service interruptions, downtime, or technical failures
  • Unauthorized access to or alteration of your transmissions or data
  • Actions or omissions of our Clients or third parties
  • Your violation of these Terms

11. Indemnification

You agree to indemnify, defend, and hold harmless Hill Country Guide AI, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use or misuse of our chatbot services
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your violation of any applicable laws or regulations
  • Any content you submit through our chatbots

12. Service Availability and Modifications

12.1 Service Availability

We strive to provide reliable chatbot services but do not guarantee uninterrupted availability. We reserve the right to:

  • Temporarily or permanently suspend or discontinue services
  • Perform maintenance, updates, or improvements
  • Modify features or functionality
  • Limit access to certain features or users

12.2 Changes to Terms

We may modify these Terms at any time. Material changes will be effective upon posting the updated Terms with a new "Last Updated" date. Your continued use of our services after changes constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.

13. Termination

13.1 Termination by Us

We reserve the right to suspend or terminate your access to our chatbot services at any time, without notice, for any reason, including but not limited to:

  • Violation of these Terms
  • Fraudulent, abusive, or illegal activity
  • Requests from law enforcement or government agencies
  • Discontinuation of services

13.2 Effect of Termination

Upon termination:

  • Your right to use our chatbot services immediately ceases
  • We may delete your information subject to our data retention policies
  • Provisions that by their nature should survive (indemnification, limitation of liability, etc.) will remain in effect

14. Dispute Resolution

14.1 Informal Resolution

Before filing any formal dispute, you agree to contact us first and attempt to resolve the issue informally. Please send a detailed description of your concern to support@hillcountryguideai.com. We will attempt to resolve the matter within 30 days.

14.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.

14.3 Arbitration Agreement

Any dispute, claim, or controversy arising out of or relating to these Terms or our services that cannot be resolved informally shall be settled by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The arbitration shall be conducted in Texas, and judgment on the arbitration award may be entered in any court having jurisdiction.

14.4 Class Action Waiver

YOU AND HILL COUNTRY GUIDE AI AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

14.5 Jurisdiction and Venue

To the extent arbitration does not apply, you agree that any legal action or proceeding shall be brought exclusively in the state or federal courts located in Texas, and you consent to the personal jurisdiction of such courts.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hill Country Guide AI regarding your use of our chatbot services and supersede all prior agreements and understandings.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

15.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. No waiver shall be effective unless in writing and signed by an authorized representative of Hill Country Guide AI.

15.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms at any time without notice to you, including in connection with a merger, acquisition, or sale of assets.

15.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, natural disasters, internet outages, or failures of third-party services.

15.6 Headings

The headings in these Terms are for convenience only and have no legal or contractual effect.

15.7 Language

These Terms are written in English. Any translations are provided for convenience only. In the event of any conflict between the English version and a translation, the English version shall prevail.
